The General Court of the EU, by its judgment published on 29 November 2016, upheld the action submitted by the company ANKO against the Research Executive Agency (REA).
The defense of the case was entrusted to “Christianos and Partners Law Firm”.
By its action lodged under Article 272 TFEU the company asked the Court to declare firstly, that the suspension of payment which the REA had applied with respect to an amount due to the applicant as its contribution to a project in the context of the FP7 program is in breach of its contractual obligations and, secondly, that that sum should be paid to ΑΝΚΟ, with interest from the date of lodging the action.
The General Court granted the forms of order sought by the company.
