By judgment C-701/21 P delivered on 22 February 2024, the Court of Justice of the European Union annulled the judgment of the General Court in joined cases T- 639/14 RENV, T-352/15 and Τ-740/17 and sent back the cases to the General Court for further appraisal.
According to the Court, the General Court failed to ascertain whether the arbitration tribunal of the Greek Energy Regulator (RAE) had mandatory jurisdiction, as is, the case, generally, for courts which form part of the State judicial system. In this regard, the General Court erred in law in not distinguishing the arbitration tribunal from ordinary courts and in, subsequently, holding that the arbitration award was equivalent to a State measure constituting State aid under Article 107 (1) TFEU.
