By judgment C-111\/22 P delivered on 11 January 2024, the Court of Justice of the European Union held that the General Court by its judgement T- 159\/20 erred in law in interpreting the requirement of impartiality incumbent on the institutions and bodies of the Union under article 41(1) of the Charter.<\/p>\n
According to the Court, the General Court erred in holding that the requirement of objective impartiality is not infringed where the requests of an official in the context of administrative proceedings are decided by a person who has testified as a witness in a criminal case against the official- the official, in that criminal case, was, in fact, acquitted.<\/p>\n
