Judgment of the General Court of the EU in Case T‑750/22: Dismissal of the action for annulment against a decision of the European Securities and Markets Authority (ESMA)

Within the framework of a tendering procedure addressed to European undertakings, concerning the provision of information and communications technology consultancy services, the second tenderer lodged an action for annulment of the decision awarding the contract to the first tenderer.

By Judgment T‑750/22, delivered on 29 October 2025, the General Court dismissed the action for annulment brought by the second tenderer against the decision of ESMA. The General Court found that ESMA, in exercising the wide discretion conferred upon it, did not err in determining that the tender submitted by the first tenderer was not abnormally low within the meaning of the EU Financial Regulation.
