Our team successfully defended a disabled candidate before the Complaints Board of the European Schools, appealing the decision to deny the candidate the European Baccalaureat.
In its decision of 7 March 2024, it was held that the European School in Brussels had failed to comply with the special measures which it had itself accepted during the administration of the Baccalauréat exams. As a result, the Board annulled the decision that refused to award the candidate the Baccalauréat.
Notably, the Board held for the first time that the Charter of Fundamental Rights of the European Union, and in particular Article 26 on the integration of persons with disabilities, applies to the interpretation of the rules governing the European Schools in this matter.
